Classic Package Licensing Agreement

Agreement of “One Time, Single Use” License to use Architectural Home Plan

Shemss, Inc. grants you a non-exclusive license to use this house plan package and its contents (hereafter referred to as "design," "interior design," and "exterior design") for the construction and design of your or your client's home, subject to the following terms and conditions.

1. License Grant

1. The Licensee is granted a non-exclusive, non-transferable, single-use license to use the CAD Master Set (DWG file) and/or PDF under the following conditions:
   • Single-Build License: The Licensee may use the plans for the construction of oneresidential unit.
   • Modifications Allowed: The Licensee may modify the plan for personal use or with a hired professional.
   • Reproduction: The Licensee may print and tailor the plans as necessary for the construction of the licensed project at the address stated above.
   • Local Use Only: The plans may only be used one time for construction at the address stated above unless otherwise approved by Shemss, Inc
   • Third-Party Use: The Licensee may provide the design, in whole or part, to subcontractors, contractors, suppliers, architects, and engineers for estimating and construction of one structure only.

2. Restrictions

1. No Resale or Redistribution: The Licensee may not sell, distribute, share, or upload the DWG file or PDF or any other derivative works/formats.
2. No Multiple Builds: The Licensee may only construct one home with this license. A separate license must be purchased for additional builds.
3. No Commercial Reuse: The Licensee may not use the CAD and/or PDF file for commercial resale, reproduction, or multiple development projects without written consent from Shemss.
4. No Unauthorized Alterations: The Licensee may not extract, copy, or apply any portion of the design to other projects or distribute any part of the design.
5. Preservation of Copyright: The Licensee may not remove the Shemss logo, copyright, or designer block from the plans.

3. Copyright & Ownership

• The original design remains the intellectual property of Shemss.
• The Licensee does not acquire ownership rights to the design.
• The Licensor retains the right to sell, distribute, or license the same plan to other clients.
• This license is not a sale; title and ownership remain with Shemss.

4. Liability Disclaimer

1. The Licensee is responsible to check compliance with local building codes, engineering, or structural requirements.
2. The Licensee assumes full responsibility for obtaining required permits, engineering approvals, and inspections.
3. If the Licensor is not responsible for engineering and approvals, The Licensor is not liable for any construction errors, modifications, and/or damages.

5. Additional Licensing Options (Additional Costs May Apply)

• Multi-Build License: For constructing multiple units using the same plan.
• Customization Services: Professional modifications and design changes.
• Engineering Review: Assistance with local code compliance and structural adaptation.

6. Agreement Acknowledgment

By purchasing, downloading, or using the CAD/PDF Master Set, the Licensee agrees to the terms outlined in this agreement. Violation of these terms may result in legal action.

7. Return Policy:

No returns or refunds on downloadable digital and hardcopy products.
